Curb, Gutter & Sidewalk Requirements & Waivers |

Elko City Code Section 2-4-3 requires installation of sidewalks, curbs and gutters on all lots or parcels of land which are developed or in cases where building expansion or new construction activity takes place. These requirements are to ensure that drainage issues and pedestrian safety are addressed and that public streets are available to move vehicles, goods and services. Curb, gutter and sidewalk requirements may vary depending on the specific use and zoning of a property. The City Planning and Engineering Departments should be contacted to determine the requirements of a particular development. On occasion, there may be exceptional circumstances in which a waiver or deviance from the curb, gutter and sidewalk requirements may be warranted. An applicant should contact the City Planning and Engineering Departments to discuss the circumstances and, if warranted, file a Curb, Gutter and Sidewalk Waiver application. |

A successful applicant should be prepared to have the waiver request evaluated under the following criteria: |

What happens after filing? |
|
In cases where it is determined impractical to install sidewalk, curb or gutter improvements because of drainage, topography, isolation or similar circumstance and provided there is agreement to defer improvements to a later date, your request may be processed administratively by the City Engineers Office. Otherwise, your request will be scheduled to be heard by the Elko City Planning Commission normally within 30 days from the filing date. The Planning and Engineering Staff evaluates your request and develops a Staff Report that is included with your application for the Planning Commission. Before the meeting, you will receive a meeting agenda and a copy of the Staff Report. During the Planning Commission consideration of your request, you will be asked to make an oral presentation of the facts related to your case. This will be followed by a response from the Planning and Engineering Staff. The Chairperson will then discuss the request and follow with a motion of approval or denial.If dissatisfied with the decision of the Commission, you may file an appeal to the City Council within ten (10) days of the Planning Commission decision. |
