NOTICE OF PUBLIC HEARING
ELKO CITY PLANNING COMMISSION

NOTICE IS HEREBY GIVEN that the Elko City Planning Commission will be conducting a series of public hearings on October 2, 2007, at 6:30 p.m. at Elko City Hall, 1751 College Avenue, Elko, Nevada, and that the public is invited to provide input and testimony on these matters under consideration in person, by writing, or by representative.

The specific items to be considered under public hearing format are:

  • Rezone No. 6-07 filed by MRP, LLC, to consider a change in zoning from R1 (Single Family Residential) to a combination of R (Single-Family and Multiple-Family Residential) involving approximately 5.3 acres and C (General Commercial) involving approximately 53,733 square feet of property located generally between Ruby Vista Drive and Spruce Road adjacent to the Elko Peace Park, more particularly described as follows:

    • R (Single Family and Multiple Family Residential) for a tract of land being a portion of Parcel No. 3 as shown on the Parcel Map for Martha Benti filed in the office of the Elko County Recorder, Elko, Nevada, at file number 419965; more particularly described as follows:

    Commencing at the most southerly corner of said Parcel No. 3;
    thence North 43˚32’07” West, along the southwesterly boundary of said Parcel No. 3, a distance of 216.70 feet to Corner No.1, the Point of Beginning;
    thence North 43˚32’07” West, continuing along the southwesterly boundary of said Parcel No. 3, a distance of 200.00 feet to Corner No. 2;
    thence North 89˚45’12” West, along the southerly boundary of said Parcel No. 3, a distance of 550.27 feet to Corner No. 3, being the southwest corner of said Parcel No. 3;
    thence North 00˚14’48” East, along the westerly boundary of said Parcel No. 3, a distance of 270.00 feet to corner No. 4, being the northwest corner of said Parcel No. 3;
    thence South 89˚45’12” East, along the northerly boundary of said Parcel No. 3, a distance of 651.63 feet to Corner No. 4, being the northeast corner of said Parcel No. 3;
    thence South 43˚32’07” East, along the northeasterly boundary of said Parcel No. 3, a distance of 324.80 feet to Corner No. 5;
    thence South 46˚27’53” West, a distance of 260.00 feet to Corner No. 1, the Point of Beginning.

    • C (General Commercial) for a tract of land being a portion of Parcel No. 3 as shown on the Parcel Map for Martha Benti filed in the office of the Elko County Recorder, Elko, Nevada at file number 419965; more particularly described as follows:

    Commencing at the most southerly corner of said Parcel No. 3, being Corner No. 1, the Point of Beginning;
    thence North 43˚32’07” West, along the southwesterly boundary of said Parcel No. 3, a distance of 216.70 feet to Corner No. 2;
    thence North 46˚27’53” East, a distance of 260.00 feet to Corner No. 3, a point on the northeasterly boundary of said Parcel No. 3;
    thence South 43˚32’07” East, along the northeasterly boundary of said Parcel No. 3, a distance of 199.37 feet to Corner No. 4, the most easterly corner of said Parcel No. 3;
    thence from a tangent bearing South 49˚45’21” West, along the southeasterly boundary of said Parcel No. 3 on a circular curve to the left with a radius of 335.00 feet, through a central angle of 07˚47’00”, an arc distance of 45.51 feet to Corner No. 5;
    thence South 41˚58’21” West, continuing along the southeasterly boundary of said Parcel No. 3, a distance of 215.19 feet to Corner No. 1, the Point of Beginning. 
               
    The type and nature of the proposed use on the property is development of 4-6 multi-family residential units and ten (10) affordable housing units with compatible convenience retail business development. 

  • Conditional Use Permit No. 6-07, filed by Dr. Dean E. Ward, to allow a medical office use in an R (Single-Family and Multiple-Family Residential) zoning district involving an existing structure generally located on the northeast corner of 5th Street and Pine Street. (503 Pine Street).

  •  Rezone No. 7-07, filed by Giuliana Murphy to consider a change in zoning from AG (General Agricultural) to R (Single-Family and Multiple-Family Residential) involving approximately 1.35 acres of property located generally on the southwest side of Fourth Street 100 feet southeast of the intersection of Fourth Street and Washington Avenue being a parcel of land located in the NW¼NW¼ of Section 23, T. 34 N., R. 55 E., M.D.B. & M. in the City of Elko, County of Elko, State of Nevada, more particularly described as follows:

Commencing at the monument at the intersection of S. 4th Street and Wilson Ave. as shown on the official map of Beigler Addition, No. 2 to the City of Elko, filed in the office of the County Recorder, Elko County Nevada (File No. 92140), thence S. 48˚11’ E along the center line of S. 4th Street and its extension 1163.45 ft; thence S. 41˚49’ W. 40 feet to the northerly most corner of the property of Giuliana Murphy as described by deed recorded January 21, 1983 in Book 414 at page 8 records of Elko County Nevada said point being the True Point of Beginning; thence S. 41˚49’ W. 217.80 feet along the northwesterly line of said Murphy property to the westerly most corner thereof; thence N. 48˚11’ W. 177.87 feet to a point on the easterly line of a 60' wide road easement granted to the City of Elko by document dated June 8, 1970 and recorded in Book 126 at page 511, file No. 50837 records of Elko County Nevada; thence N. 1˚30’06” E. 285.64 feet along said line to a point on the southwest line of S. 4th Street extended; thence S. 48˚11’ E. 362.68 feet along said Southwest line to the point of beginning.

The type and nature of the proposed use is placement of a single family residence.  
 

  • Review and consideration of Variance No. 4-07 filed by Charles and Barbara Galloway for a reduction of the required exterior side yard setback from 15 feet to 12 feet and a reduction of the required rear yard setback from 10 feet to 3 feet for a proposed detached accessory building generally located at the southeast corner of Parkview Drive and Keppler Drive (1300 Parkview Drive). 
  • Review, consideration and possible action of the Planning Commission to approve by Resolution an update and refinement of the Land Use Map of the Elko City Master Plan, and matters related thereto.   The purpose and intent of the update is to include, incorporate and reflect areas recently annexed to the City and areas that may have been subject to significant changes in zoning, on the Land Use Map.
